NOTICE OF CANCELLATION OF REGULAR ELECTION
BY THE DESIGNATED ELECTION OFFICIAL FOR THE
UPPER BEAR CREEK WATER AND SANITATION DISTRICT
NOTICE IS HEREBY GIVEN by the
Upper Bear Creek Water and Sanitation District, Clear Creek and Jefferson
Counties, Colorado, that at the close of business on the sixty-third (63rd)
day before the election there were not more candidates for director than offices
to be filled, including candidates filing affidavits of intent to be write-in
candidates; therefore, the election be held on May 4, 2010, is hereby cancelled
pursuant to Section 1-5-208 (1.5), C.R.S.
The following candidates are declared elected:

District Update from the Board of Directors

2010
brings a number of changes to the Upper Bear Creek Water and Sanitation
District. The UBCWSD appointed two new Board Members to fill vacancies left by
retiring Board members Art Burzlaff and Bob Brown. The Board appreciates the
years of service and contributions of both of these Directors to the District.
The new appointees are Dennis Ferdinandsen from the Troutdale area in Jefferson
County, and Patrick Kuberski from Circle K in Clear Creek County. They join
current Board Members Peggy Stokstad, Bill Trimble, and Jim Jackson. There will
be an election for four positions on the Board in May of 2010.
In order to cover direct capital costs to UBCWSD for
improvements to the wastewater infrastructure the Upper Bear Creek Water and
Sanitation Board of Directors is increasing the monthly wastewater charge by $3
to $45.50. With aging infrastructure and ongoing requirements from State and
Federal agencies, the District will be required to make improvements to its
wastewater treatment facility, and an increase in rates is necessary to cover
the costs of improvements. Specifically, in 2010 the District will be
finishing its treatment building roof replacement project, and the revamp of the
wastewater plant’s odor control processes.

Public Notice is hereby given that
the regular meetings of the Board of Directors of the Upper Bear Creek Water and
Sanitation District for the year 2010 will be held on the second Tuesday of
every month commencing at the hour of 5:00 PM at the offices of the District
located at 30920 Stagecoach Boulevard, Evergreen, Colorado 80439, at which time
and place the business of the Board will be conducted and will be open to the
public.

NOTICE OF
BUDGET HEARING
PUBLIC NOTICE IS HEREBY GIVEN that a proposed budget has
been submitted to the Upper Bear Creek Water and Sanitation District
(‘District”) for the ensuing year of 2010. Such proposed budget will be
considered at the regular meeting of the District commencing at the hour of 5:00
PM on Tuesday, November 10, 2009.
A copy of the proposed 2010 budget is available for
public inspection at the office of the District, 30920 Stagecoach Blvd.,
Evergreen, Colorado (telephone number 303-674-4112). Any interested elector
within such District may, at any time prior to the final adoption of the budget,
file or register any objections thereto. Dated October 30, 2009.
